General Terms & Conditions
1. REGISTRATION AT NOT ANOTHER COACHING COMPANY (NACC)
Participants in trainings, workshops, coaching programmes and other services provided by Not Another Coaching Company (NACC) are considered definitively registered once they have completed the registration form via the website, or have otherwise confirmed clearly and unambiguously in writing or by email that they wish to participate in a programme offered by NACC.
NACC reserves the right to refuse a registration in accordance with the provisions set out in these general terms and conditions.
By registering for a service or programme offered by NACC, the participant declares that they have taken note of and agree to the general terms and conditions and privacy statement of NACC.
2. INTAKE AND INTRODUCTORY MEETING
If participation in a programme is preceded by an intake or introductory meeting, definitive registration is subject to the outcome of this meeting.
NACC reserves the right, based on the intake or introductory meeting, to decide not to admit a candidate to participate in the programme.
If participation is refused by NACC, any amount already paid by the candidate will be fully refunded.
3. REGISTRATION VIA INTERNET
If registration takes place online, and insofar as the agreement qualifies as a distance consumer contract, the participant has the statutory right to cancel the agreement free of charge and without stating reasons within 14 days after registration.
To exercise the right of withdrawal, the participant must notify NACC in writing or by email within this period via info@notanother.nl.
If the participant expressly agrees to the commencement of the services within the statutory 14-day withdrawal period, the right of withdrawal expires from the moment the services have been fully or partially performed.

4. PAYMENT TERMS
Registration and participation fees should preferably be paid directly via the website using iDEAL.
If payment is not made immediately upon registration, the participant will receive an invoice. Invoices must be paid in full within 14 days of the invoice date. NACC reserves the right to charge administrative fees in such cases.
If the payment term is exceeded, the participant shall be legally in default without further notice. In that case, NACC is entitled to charge administrative fees, statutory interest and any extrajudicial collection costs in accordance with the applicable statutory regulations regarding collection costs.
If payment remains outstanding, NACC reserves the right to exclude the participant from participation in the programme and to assign the reserved place to another participant. In such cases, the payment obligation shall remain fully in force.
Any credited amounts will be refunded by NACC within 14 days after the date of the credit invoice.
5. CANCELATION POLICY
Cancellation of participation must be made in writing or by email. The date on which the cancellation is received by NACC shall be regarded as the official cancellation date.
5.1 Statutory withdrawal period
In the case of online registration, and insofar as the agreement qualifies as a distance consumer contract, the participant has the statutory right to withdraw from the agreement free of charge and without stating reasons within 14 days after registration.
However, if the participant has expressly agreed to the commencement of the services within this statutory withdrawal period, the right of withdrawal expires from the moment the services have been fully or partially performed.
Any amounts already paid to which the right of withdrawal applies will be refunded within 14 days after receipt of the written cancellation.
5.2 Cancellation up to two weeks before commencement
In the event of cancellation after the statutory withdrawal period and up to two weeks before the start of the programme, 25% of the total registration fee shall be payable.
5.3 Cancellation within two weeks before commencement
In the event of cancellation within two weeks before the start of the programme, the full registration fee shall remain payable, regardless of whether this amount has already been paid in whole or in part.
5.4 Early termination or missed sessions
In the event of early termination of participation by the participant, or failure to attend sessions, no right to refund or replacement sessions shall exist, unless otherwise agreed in writing.
5.5 Replacement participant
If the originally registered participant proposes a replacement participant who has not yet registered with NACC and who, in the opinion of NACC, meets the participation requirements of the programme, only 10% of the registration fee shall be charged to cover administrative costs. These costs shall be borne by the originally registered participant.
6. RESCHEDULING OR POSTPONING DATES
Rescheduling or postponing participation in a programme to a different date shall be regarded as a cancellation. Such changes are only possible with the prior consent of NACC and after payment of any applicable administrative fees.
7. CANCELATION OF TRAININGS AND WORKSHOPS
NACC reserves the right, in the event of unforeseen or compelling circumstances, to reschedule one or more course days or to make substantive changes to the programme.
In addition, NACC reserves the right to cancel a course, training or programme in the event of insufficient registrations.
If a programme is cancelled due to insufficient registrations, participants will be informed no later than one week prior to the start of the programme.
In the event of cancellation by NACC, any participation fees already paid will be fully refunded. In such cases, the participant shall not be entitled to any additional compensation or damages.
8. CANCELLATION OF INTAKES AND INDIVIDUAL CONSULTATIONS
Individual appointments must be cancelled at least 24 hours in advance by telephone, WhatsApp, text message or email.
In the event of late cancellation or failure to attend a scheduled intake, consultation or other individual appointment, NACC is entitled to charge the full agreed session fee. In the case of an intake session, a fee of €95 will be charged.
If NACC is unexpectedly unable to attend and a scheduled individual appointment cannot take place without timely notice, the participant will receive a €95 discount on a future individual session.
9. CUSTOMISED AND IN-COMPANY PROGRAMMES
NACC regularly develops and provides customised programmes for companies, institutions, foundations, associations and groups of participants.
For such assignments, a quotation will be prepared describing, among other things, the structure of the programme, the general content, the costs, payment terms and cancellation conditions.
By providing written approval of the quotation and commissioning the programme, the client agrees to the applicability of these general terms and conditions.
These general terms and conditions also apply to all customised and in-company programmes provided by NACC.
10. LIABILITY AND PERFORMANCE OF SERVICES
10.1 All assignments are accepted and performed exclusively by NACC.
10.2 In the performance of its services, NACC may engage third parties, such as guest teachers, trainers, coaches, facilitators or other professionals involved. NACC shall exercise due care in selecting such third parties. NACC shall not be liable for shortcomings or damages caused by such third parties, unless there is intent or gross negligence on the part of NACC.
10.3 All services are performed exclusively for the benefit of the client or participant. Third parties cannot derive any rights from the content of the services performed, trainings, coaching sessions or materials provided.
10.4 Information and administration relating to assignments, participants and services shall be retained for a maximum period of five years, unless a different retention period is required by law. After this period, such information may be deleted or destroyed.
11. CONDUCT & BEHAVIOUR
If a participant engages in misconduct, inappropriate or abusive behaviour, intimidation, aggression, discrimination, or otherwise harms the safety, atmosphere, reputation or good name of NACC, the trainer, other participants or the venue, NACC reserves the right to immediately deny the participant further access to the programme. In such cases, no refund of any amounts already paid shall be granted.
12. LIABILITY
Participation in trainings, coaching, workshops and retreats provided by Not Another Coaching Company (NACC) takes place at the participant’s own responsibility. Participants remain at all times responsible for respecting their own physical and mental boundaries and limitations and for making their own decisions regarding participation in exercises and activities.
NACC shall not be liable for injuries, physical harm, psychological or emotional complaints, or any other damages arising during or as a result of participation, except in cases of intent or gross negligence on the part of NACC.
In the case of physical or psychological complaints, participants are advised to consult a general practitioner or treating specialist in advance to assess whether participation is appropriate. Participants remain responsible for sharing information that may be relevant to safe participation. NACC reserves the right to refuse participation if participation is reasonably considered unsuitable, for example due to insufficient expertise regarding a specific condition or situation.
NACC shall not be liable for loss, theft or damage to participants’ personal belongings.
Participants are liable for damage to the training space, venue or inventory if such damage is the result of intentional actions or careless behaviour on the part of the participant.
13. COMPLAINT POLICY
NACC highly values careful service and sustainable relationships. Despite our commitment and efforts, it is possible that you may be dissatisfied with our services or that a misunderstanding may arise. In such cases, we kindly invite you to inform us as soon as possible so that we may work together towards an appropriate solution.
11.1 Submitting a complaint
We appreciate it when complaints are first discussed in mutual consultation. If you wish to submit a complaint, you may do so in writing to:

Please describe the complaint as clearly as possible, including any relevant dates, correspondence or circumstances.
11.2 Complaint procedure
Receipt of the complaint will be confirmed as soon as possible.
NACC will contact the complainant within a maximum of 15 working days in order to discuss the complaint and, where necessary, request additional information.
We aim to handle complaints carefully within 30 working days. If additional time is required, the complainant will be informed in a timely manner, including an indication of the expected timeframe.
After completion of the complaint procedure, the complainant will receive written confirmation of the outcome.
All complaints and their handling will be treated confidentially and recorded with due care.
11.3 Retention period
Complaints and related correspondence will be registered and retained for a period of three years.
11.4 Additional provisions
Submitting a complaint does not suspend any payment obligations of the participant or client.
14. INTELLECTUAL PROPERTY AND USE OF MATERIALS
All materials provided by NACC, including texts, photographs, audio instructions, videos, course materials, hand-outs and other content provided during trainings, coaching, workshops, retreats, through the website, blog or newsletters, are the property of Khawla Shehadeh / Not Another Coaching Company (NACC), unless explicitly stated otherwise.
These materials are protected by Dutch and international copyright laws and other intellectual property rights.
Without prior written permission from NACC, it is not permitted to copy, publish, distribute, reproduce, commercially use, or make available to third parties any materials in whole or in part.
If written permission is granted for publication or use of materials, clear attribution and source reference must always be included, including reference to the website www.notanother.nl.
Image, audio or video recordings may only be used in the manner agreed upon in writing with NACC in advance.
